| dc.description.abstract | O presente trabalho analisa os limites jurídicos e éticos da recriação digital de pessoas falecidas por meio da inteligência artificial (IA), com foco no caso da campanha publicitária da Volkswagen que trouxe a cantora Elis Regina, falecida em 1982, em uma performance digital ao lado de sua filha, Maria Rita. O estudo busca compreender como tecnologias como deepfakes, CGI e IA generativa desafiam o ordenamento jurídico brasileiro, especialmente no que se refere à proteção da imagem, da memória e da dignidade humana. Para tanto, foi realizada uma análise documental, doutrinária e legislativa, considerando a Constituição Federal de 1988, os artigos 11 a 21 do Código Civil e a Lei Geral de Proteção de Dados Pessoais (Lei nº 13.709/2018), além de pareceres de especialistas e reportagens jornalísticas sobre o caso. O trabalho também examina decisões judiciais relevantes, como o REsp 521.697/RJ do Superior Tribunal de Justiça, e propostas legislativas como o PL 3.592/2023, que visam regulamentar o uso da imagem de pessoas falecidas. Os resultados demonstram que a prática de recriação digital envolve dilemas complexos, incluindo a coisificação da pessoa, a mercantilização da memória e a necessidade de consentimento familiar, bem como lacunas normativas que ainda não contemplam de forma clara o uso de recursos tecnológicos para “ressuscitar” pessoas falecidas. Conclui-se que é imprescindível estabelecer limites éticos e legais para o uso da IA em contextos culturais e publicitários, garantindo a proteção dos direitos de personalidade post mortem e o respeito à memória de indivíduos falecidos, sem impedir o avanço tecnológico. | pt_BR |

The study seeks to understand how technologies such as deepfakes, CGI, and generative AI challenge the Brazilian legal system, especially regarding the protection of image, memory, and human dignity. To this end, a documentary, doctrinal, and legislative analysis was conducted, considering the 1988 Federal Constitution, articles 11 to 21 of the Civil Code, and the General Personal Data Protection Law (Law No. 13,709/2018), as well as expert opinions and journalistic reports on the case. The results demonstrate that the practice of digital recreation involves complex dilemmas, including the objectification of the person, the commodification of memory, and the need for family consent, as well as regulatory gaps that still do not clearly address the use of technological resources to "resurrect" deceased individuals. The conclusion is that it is essential to establish ethical and legal limits on the use of AI in cultural and advertising contexts, ensuring the protection of personality rights post mortem and respect for the memory of deceased individuals, without impeding technological advancement. | pt_BR |
