dc.description.abstractO presente trabalho consiste em um estudo acerca da compatibilidade de uma situação atual, qual seja, o uso excessivo das prisões preventivas nos últimos anos, no Brasil, com o modelo de processo adotado pela Constituição Federal de 1988. Constata-se que o encarceramento em massa é uma realidade na qual os detentos provisórios têm representado parcela considerável dos custodiados. Diante desse cenário e, sabendo que a unidades prisionais apresentam precárias condições estruturais, dificultando, com isso, a ressocialização do preso, reconhece-se que, na tramitação de processos criminais, a liberdade, enquanto valor constitucional, é, por vezes, prejudicada. Essa violação deriva-se, por exemplo, da decretação excessiva de prisões preventivas, configurando, na prática, um mecanismo de antecipação da pena. Assim, inicialmente se verifica qual o modelo processual previsto hoje pela Constituição Federal e se o processo penal garantista adequa-se a esse parâmetro. Após esse momento, investigar-se a existência de uma prática desmoderada na decretação das prisões preventivas no Brasil, comparando-se brevemente as informações encontradas com dados de países americanos, especialmente os Estados Unidos, ocasião em que se analisam as causas e as consequências dessa constatação. Por fim, exploram-se as possíveis soluções para que se atinja, de forma mais eficaz, a harmonia entre as decretações das custódias preventivas e o direito fundamental ao processo, ideia defendida pela Teoria Constitucionalista. Para a elaboração deste trabalho foi empregada pesquisa teóricobibliográfica e documental, com abordagem qualitativa-quantitativa, sendo detalhadas descrições de situações e comportamentos subjetivos humanos, assim como analisados dados estatísticos. Em relação ao resultado, a pesquisa caracteriza-se por ser pura, servir de aporte teórico em eventual iniciativa de mudança e ter um caráter descritivo, dado o seu intuito de solucionar um impassept_BR

dc.description.resumo_abstractThe present work consists of a study on the compatibility of a current situation - the excessive use of preventive prisons in recent years in Brazil - with the process model adopted by our Federal Constitution. It appears that mass incarceration in our country is a reality, in which provisional detainees have represented a considerable portion of those in custody. Given this scenario, and knowing that prisons have precarious structural conditions, making it difficult for the prisoner to resocialize, it is recognized that, in the course of criminal proceedings, freedom, a constitutional value, is sometimes impaired. This violation derives, for example, from the excessive decree of preventive arrests, configuring, in practice, a mechanism for the anticipation of the sentence. Thus, initially, it will be verified what is the procedural model provided, nowadays, by the Federal Constitution of 1988 and if the guaranteeing criminal procedure fits this parameter. After this moment, it will be investigated if there is, in fact, an inordinate practice in the decree of preventive detentions in Brazil, briefly comparing the information found with data from American countries, especially the United States, analyzing the causes and consequences of this finding. Finally, possible solutions will be explored to achieve, more effectively, harmony between the decrees of preventive custody and the fundamental right to process, an idea defended by the Constitutionalist Theory. For the elaboration of this work, theoretical-bibliographic and documentary research was used, with a qualitativequantitative approach, with detailed descriptions of situations and subjective human behaviors, as well as statistical data analyzed. Regarding the result, the research is characterized as being pure, as it serves as a theoretical support in an eventual change initiative, and also has a descriptive character, given its intention to solve an impasse.pt_BR
