dc.description.abstractA atividade empresarial é fundamental para a geração de empregos, circulação econômica, geração de impostos e receita para o Governo. Nesse sentido, a crise e, principalmente, a quebra de um estabelecimento reverberam no equilíbrio do mercado e afetam todo o ecossistema, proporcionalmente ao porte da empresa em dificuldades, o grau de dependência da comunidade próxima da atividade e diversos outros fatores. Por tal razão, a legislação brasileira trouxe uma profunda modificação na sua essência, saindo de uma estrutura solutória-liquidatória para um procedimento tendente a respeitar a função social da empresa no ambiente econômico; instrumentalizando à empresa viável meios de se reestruturar e se reposicionar no mercado;e enfatizando a manutenção dos postos de trabalho, a fonte de receita e de tributos, ainda que com o sacrifício não somente do empresário e seus acionistas, mas de todas as partes (credores, trabalhadores, fisco). Após 15 anos de sua vigência, fez-se necessária a revisão do texto legal, incorporando-se o posicionamento sedimentado da jurisprudência, retificando os pontos críticos vivenciados e modernizando institutos já testados, afastando e mitigando o risco de fraude, além de buscar a efetividade do procedimento e a extirpação dos maus empresários do mercado. Nesse diapasão, foi promulgada a Lei 14.112/20 que, em que pese as referidas qualidades, trouxe consigo a pressão da crise decorrente da pandemia e a necessidade premente de atender demandas iminentes dela decorrentes. Da mesma forma, a influência e o engessamento da postura do Fisco ainda não foram capazes de trazer à Lei as ferramentas adequadas para uma plena recuperação das atividades empresariais realmente viáveis. A grande tormenta foi e continua sendo o tratamento adequado ao passivo tributário das empresas em crise à luz do Art. 68 do diploma falimentar e sua efetiva regulamentação, mesmo com a nova reformulação. O trabalho em questão aborda exatamente tais modificações e os impactos daí advindos na efetividade da recuperação do passivo tributário. Para tal desiderato, foi realizado o levantamento de processos de recuperação judicial propostos entre 2015 e 2021 na comarca de Fortaleza - CE, com seus respectivos planos de recuperação judicial, aferindo as propostas de pagamento e os possíveis tratamentos propostos ao crédito tributário. Tabulada a pesquisa, o levantamento apurou que mesmo após a reforma e ampliação das ferramentas fiscais em relação aos recuperandos, o cenário continua o mesmo e o dilema entre a quebra da empresa e o prejuízo social permanece incólume. A partir dos achados, desenvolveu-se uma metodologia de cálculo com o intuito de aferir a recuperabilidade empresarial e identificar o índice de retomada, possibilitando a sincronia entre o crescimento da empresa e o pagamento dos impostos e credores, viabilizando a efetiva recuperação.pt_BR

dc.description.resumo_abstractBusiness activity is fundamental for the generation of jobs, economic circulation, generation of taxes and revenue for the government. The breakdown of an establishment in the sense and the reversion to the entire company, proportionally to the dependence of the activity and several factors. For this reason, the Brazilian legislation brought a modification in its essence, deepening in a li-solution structure, transforming a li-solution structure, to a procedure tending to respect a social function of the company in the environment, providing instruments to the viable company to restructure and reposition itself in the economic market, emphasizing the maintenance of jobs, the source of revenue and taxes, albeit with tribute not only to the entrepreneur and his shareholders, but to everyone (creditors, workers, tax authorities). 15 years after its revision, it was necessary to revise the text, incorporating the sedimented positioning of jurisprudence and modernizing the critical points already tested, mitigating and mitigating after the test, the procedure and the extirpation of bad entrepreneurs from the market. In this vein, Law 14.112/20 was enacted which, despite this quality, brought with it the pressure of the crisis resulting from the pandemic and a predetermined need for subsequent imminent demands. In the same way, the influence and rigidity of the Tax Authorities' posture have not yet been able to bring the Law the appropriate tools for a full recovery of truly viable business activities. The great storm was and continues to be the adequate treatment of the tax liabilities of companies in crisis in the light of Art. 68 of the bankruptcy law and its effective regulation, even with the novel reformulation. The work in question addresses exactly such changes and the resulting impacts on the effectiveness of tax liability recovery. For this purpose, a survey of judicial recovery processes proposed between 2015 and 2021 in the region of Fortaleza-CE, with their respective judicial recovery plans, was carried out, assessing the payment proposals and the possible proposed treatments for the tax credit. After tabulating the research, the survey found that even after the reform and expansion of the tax tools in relation to those recovering, the scenario remains the same and the dilemma between the company's bankruptcy and the social loss remains unscathed. Based on the findings, a calculation methodology was developed in order to assess the business recoverability and identify the recovery rate, enabling the synchrony between the company's growth and the payment of taxes and creditors, enabling the effective recovery.pt_BR
