dc.description.abstractO presente trabalho analisa o reconhecimento judicial da paternidade socioafetiva nas hipóteses em que, mesmo diante da negativa do exame de DNA e da inexistência de vontade do homem em permanecer exercendo a parentalidade, mantém-se a paternidade registral sob o fundamento da existência de vínculo afetivo, bem como os efeitos jurídicos decorrentes dessa relação. Antes de adentrar propriamente na análise da relativização do exame de DNA, mostrou-se necessária a realização de uma análise histórica acerca da evolução do conceito de família no ordenamento jurídico brasileiro, especialmente a partir da influência do Direito Romano, do modelo patriarcal consagrado no Código Civil de 1916 e das transformações promovidas pela Constituição Federal de 1988 e pelo Código Civil de 2002. Da mesma forma, revelou-se indispensável o estudo das múltiplas formas de constituição familiar reconhecidas pelo Direito contemporâneo, sobretudo daquelas fundadas na afetividade, a fim de contextualizar a consolidação da socioafetividade nas relações familiares e possibilitar melhor compreensão da problemática central desenvolvida na pesquisa. Posteriormente, analisa-se o papel do exame de DNA e dos demais meios de prova nas ações negatórias de paternidade cumuladas ou não com a anulação do registro civil, bem como a tendência jurisprudencial do Superior Tribunal de Justiça quanto à manutenção da paternidade socioafetiva diante da negativa da prova genética. Além disso, são examinados os possíveis reflexos decorrentes do Projeto de Lei nº 4/2025 no instituto da paternidade socioafetiva. A pesquisa possui natureza bibliográfica, descritiva e qualitativa, adotando o método hipotético-dedutivo, mediante análise de doutrinas, legislações, artigos acadêmicos e decisões judiciais. Ao final, conclui-se que, embora a socioafetividade possua elevada relevância no Direito de Família contemporâneo, o afeto não pode ser imposto judicialmente nas situações em que inexiste vínculo biológico aliado à ausência de vontade genuína do homem de permanecer exercendo a parentalidade, sobretudo porque, nessas circunstâncias, o próprio sentido da socioafetividade acaba se esvaziando, uma vez que o afeto pressupõe e remete à ideia de reciprocidade e livre vontade.pt_BR

dc.description.resumo_abstractThis study analyzes the judicial recognition of socio-affective paternity in cases where, despite the negative DNA test result and the absence of the man’s intention to continue exercising parenthood, the registered paternity is maintained on the grounds of the existence of an affective bond, as well as the legal effects arising from such relationship. Before addressing the relativization of DNA evidence itself, it was necessary to conduct a historical analysis of the evolution of the concept of family within the Brazilian legal system, especially considering the influence of Roman Law, the patriarchal model established by the Brazilian Civil Code of 1916, and the transformations introduced by the Federal Constitution of 1988 and the Civil Code of 2002. Likewise, the study of the multiple forms of family constitution recognized by contemporary law, particularly those founded on affectivity, proved indispensable in order to contextualize the consolidation of socio-affectivity in family relationships and to provide a better understanding of the central issue developed in this research. Subsequently, the study examines the role of DNA testing and other means of evidence in actions contesting paternity, whether or not combined with requests for annulment of civil registration, as well as the jurisprudential tendency of the Brazilian Superior Court of Justice to maintain socio-affective paternity despite the negative genetic evidence. In addition, the possible impacts of Bill No. 4/2025 on the institute of socio-affective paternity are analyzed. The research is bibliographical, descriptive, and qualitative in nature, adopting the hypothetical-deductive method through the analysis of legal doctrine, legislation, academic articles, and judicial decisions. In conclusion, although socio-affectivity holds great relevance in contemporary Family Law, affection cannot be judicially imposed in situations where there is no biological bond combined with the absence of the man’s genuine willingness to continue exercising parenthood, especially because, under such circumstances, the very meaning of socio-affectivity becomes empty, since affection presupposes and refers to the idea of reciprocity and free will.pt_BR
