dc.description.abstractConsiderando o exponencial desenvolvimento da tecnologia, é evidente que o futuro chegou e as organizações necessitam se adequar a isso para se equivaler às imposições que as inovações apresentam e, assim, não ficarem atrasadas e/ou desatualizadas, pois a modernização modificou a sociedade numa celeridade incalculável, especificamente com a inserção da inteligência artificial (IA). A expectativa é acelerar e desobstruir filas dos processos judiciais, considerando que as máquinas de IA podem efetuar funções com eficiência e agilidade superior. A dificuldade consiste na investida da implantação da IA no método de tomada de decisão. O presente trabalho tem como objetivo geral demonstrar que a IA se mostra inábil em motivar as decisões judiciais, sendo necessário a utilização da fundamentação que é inerente à Teoria de Decisão judicial. Assim, o objetivo específico é refletir sobre a IA, à luz da Teoria da Decisão Judicial, demonstrando que, inserida no âmbito judicial, apresenta limitações, principalmente quando incumbida de função decisória, visto que a tecnologia ainda não é capaz de seguir todas as recomendações legais de um processo justo. A metodologia foi realizada por meio de um estudo de natureza qualitativa, com realização de uma análise bibliográfica e documental em portais oficiais de tribunais brasileiros e de notícias jurídicas, visando um mapeamento de aplicações da IA tanto no setor jurídico privado como no setor público. Concluímos que é plenamente aceitável a utilização de máquinas no judiciário quando estas têm função meramente burocrática, em trabalhos dispendiosos e repetitivos, mas não seria possível sua utilização para substituir o Magistrado no momento decisório.pt_BR

The present work has the general objective to demonstrate that AI is incapable of motivating judicial decisions, being necessary to use the reasoning that is inherent to the Judicial Decision Theory. Thus, the specific objective is to reflect on AI, in the light of Judicial Decision Theory, demonstrating that, inserted in the judicial scope, it has limitations, especially when entrusted with a decision-making function, since the technology is not yet capable of following all the recommendations. laws of fair process. The methodology was carried out through a study of a qualitative nature, with a bibliographic and documentary analysis in official portals of Brazilian courts and legal news, aiming at a mapping of AI applications in both the private and public legal sectors. We conclude that the use of machines in the judiciary is fully acceptable when they have a merely bureaucratic function, in expensive and repetitive work, but it would not be possible to use them to replace the Magistrate at the moment of decision.pt_BR
