dc.description.abstractÉ fundamental, para o convívio em sociedade, que o Estado assegure aos indivíduos a igualdade perante a lei, e na lei; o respeito, relacionado ao reconhecimento de mesmo valor como ser humano; e, também, consideração, distribuindo, igualmente, bens primários, renda e oportunidade, evitando a maximização indevida dos que já possuem recursos, sem que se garanta o mínimo suficiente para quem precisa deles. Contudo, esses deveres são prejudicados, quando o Poder Público generaliza a judicialização dos seus conflitos, provocando um excesso, sem disponibilizar e utilizar adequadamente os meios preventivos, impedindo o acesso à justiça na esfera extrajudicial, prejudicando a aplicação uniforme da lei, o alcance indiscriminado do seu conteúdo, a arrecadação de tributos, além de diminuir recursos públicos na área da saúde, educação, entre outras, comprometendo-os com despesas processuais. Nesta senda, é crucial reconhecer que o processo administrativo, a utilização dos meios auto e heterocompositivos, a observância dos precedentes e a intervenção do Ministério Público desempenham um papel fundamental na solução do problema. Com base nisso, é apontado como a utilização desses instrumentos pode colaborar com a efetivação de equidade, demonstrando que o Poder Público não deve promover a judicialização generalizada e excessiva dos seus conflitos, sob pena de graves prejuízos a toda sociedade. Para tanto, a presente pesquisa analisou legislação, artigos, livros, notas técnicas, estudos, precedentes e jurisprudência, visando compreender a relação entre a judicialização e igualdade; compreender por que as desigualdades imerecidas devem ser compensadas; quais reflexos negativos são causados pela generalização e o excesso de demandas judiciais; como os meios preventivos podem evitá-los. Como resultado, observou-se que o Estado deve disponibilizar e utilizar os meios preventivos nos seus conflitos, pois estes contribuem na sua obrigação de garantir igualdade e compensar desigualdades. Portanto, conclui-se que a generalização e o excesso de demandas judiciais, envolvendo o Poder Público, violam a garantia da igualdade formal e material e aprofunda as desigualdades imerecidas, sendo fundamental que o Estado deixe de ser um litigante habitual, através dos meios preventivos, para a adequada efetivação da equidade.pt_BR

dc.description.resumo_abstractIt is fundamental, for coexistence in society, that the State guarantees to individuals equality before the law, and in the law; respect, related to the recognition of the same value as a human being; and, also, consideration, equally distributing primary goods, income and opportunity, avoiding the undue maximization of those who already have resources, without guaranteeing the minimum sufficient for those who need them. However, these duties are undermined when the Public Power generalizes the judicialization of its conflicts, causing an excess, without making available and properly using preventive means, preventing access to justice in the extrajudicial sphere, harming the uniform application of the law, the indiscriminate scope of its content, the collection of taxes, in addition to reducing public resources in the area of health, education, among others, committing them to procedural expenses. In this path, it is crucial to recognize that the administrative process, the use of self and heterocompositive means, the observance of precedents and the intervention of the Public Prosecutor's Office play a fundamental role in solving the problem. Based on this, it is pointed out how the use of these instruments can collaborate with the realization of equity, demonstrating that the Public Power should not promote the generalized and excessive judicialization of its conflicts, under penalty of serious damage to society as a whole. Therefore, this research analyzed legislation, articles, books, technical notes, studies, precedents and jurisprudence, aiming to understand the relationship between judicialization and equality; understand why undeserved inequalities must be compensated; which negative reflexes are caused by the generalization and excess of legal demands; how preventive means can avoid them. As a result, it was observed that the State must make available and use preventive means in its conflicts, as these contribute to its obligation to guarantee equality and compensate for inequalities. Therefore, it is concluded that the generalization and excess of judicial demands, involving the Public Power, violate the guarantee of formal and material equality and deepen undeserved inequalities, being fundamental that the State ceases to be a habitual litigant, through preventive means , for the proper implementation of equity.pt_BR
